Tenant pesticide notice
Definition
In California, the written pesticide warning a pest company owes the tenant as well as the owner who hired it.
Why It Matters
The owner signs the contract, and California still makes the company warn the person who lives there. Before treating, a registered structural pest control company must give the owner or the owner's agent, and the tenant, a written notice naming the pest, the pesticide and its active ingredient, with a caution statement the law writes out word for word. Fumigation work needs it forty-eight hours ahead, and other work no later than the application. It may go by mail or email, by posting on the property, or by hand, and a commercial or industrial building also gets a posted notice unless the owner objects. Under a periodic contract one notice at the first treatment covers the account, but any change of pesticide needs a new one. Skipping it is a misdemeanor. Ask for the notice file on every apartment and commercial account, and read it against each product change, including any move away from the rodenticides the state has banned.
