Home solicitation contract

Definition

An agreement signed at the customer's home, which carries a right to walk away from it.

Why It Matters

California decides this by PLACE and not by who called first: any contract for services made somewhere other than the seller's own trade premises, above twenty-five dollars, is a home solicitation contract, and landscaping is named in the statute's list of home improvements. The customer has until midnight of the third business day to cancel, or the fifth if they are sixty-five or older. Two neighbors write it differently and the difference is worth knowing before pricing a book of signed work: Ohio and Florida both exclude a sale the customer requested, and Ohio also bars the seller from starting work at all while the window is open.
