Definition
A state rule that an insurer may not require its own network shop on a glass claim.
Why It Matters
The insurance panel is the network and this is the limit on it, and the limit is narrower than the name suggests. Kentucky's 2024 rule says an insured making a first-party glass claim shall not be required to use a particular shop to receive payment under the policy. Read the carve-outs, because they are most of the term: the same subsection preserves the insurer's right to maintain a network, allows it to explain the coverage and the applicable limit, and creates no private right of action. So an out-of-network shop may do the work and still be paid whatever the carrier decides, argued one claim at a time, while the same act caps what the shop may charge the insured at reasonable and customary for the state. Value the two revenue lines differently. Network work survives the statute intact; out-of-network work is a receivable with no floor under it.
