Definition

The named person certified to run the water, whose certificate is posted while the pool is open.

Why It Matters

The facility permit and the operator certificate are two different things and only one of them is attached to the building. Minnesota requires the owner to designate a trained operator, certified through a listed course, retrained at least every five years, with the certificate posted whenever the pool is open. In an owner-operated school that person is usually the seller, and the certificate leaves with them. The course is scheduled and multi-day, so a buyer who has not certified before closing, and has not hired somebody who has, is out of compliance on the first morning with a permit that is perfectly valid.
