Emergency waiver

Definition

A signed statement in the customer's own handwriting waiving the three-day right to cancel.

Why It Matters

A lockout is the textbook emergency and the exclusion is still not automatic: it has to be bought with a document the customer writes. The federal rule wants all three of a buyer who initiated the contact, a genuine immediate personal emergency, and a separate dated signed statement in the buyer's handwriting describing the situation and expressly waiving the three days. Ohio adds a substantive test, that the emergency jeopardizes welfare, health or safety or endangers property. California drops the handwriting and keeps the separate signed statement. A residential rekey is work on a fixture, so the personal-property exclusion that covers a mobile glass tech does not reach the house call. Without a conforming waiver the clock never starts and every payment goes back within ten business days. Ask to see three of them.
