Designated facility

Definition

Where a district says its waste must go, decided by where the waste was generated.

Why It Matters

Ohio's districts may designate facilities, and once one has, no person may deliver solid waste generated inside that district to any facility other than the designated one, with source separated recyclables free to go to any legitimate recycling facility. A waiver exists and is not automatic: a person or a township may ask the board to authorize delivery elsewhere, and the board must find that doing so is not inconsistent with the district plan or its financing, then act within ninety days. This is the constraint on a hauling route that diligence cannot re-paper, because it attaches to where the waste came from and not to the company, so it survives a change of owner completely and the tipping account sits downstream of it.
