Why It Matters

A hardware store that sells restricted-use products is a dealer with a record duty, and the duty sits on the PREMISES. Each individual dealership records and keeps for at least two years every transaction distributing or selling a restricted-use pesticide, carrying the buyer's name and address, the applicator's certification number with the issuing agency, its expiry and its categories, the product and its registration number, the quantity and the date. Where the federal program runs directly the dealer must also furnish those records, or permit access to them, at all reasonable times on request. Tell it apart from the applicator's own use record, which is a personal duty and walks out with the person who holds it. This file stays with the store, so a buyer inherits it and whatever it shows. It binds only a store that actually sells restricted-use products, which is the first thing to establish.
