Payment bond notice window

Definition

The dated notice a second-tier subcontractor must serve to keep a federal bond claim alive.

Why It Matters

On federal work a supplier or sub without a direct contract with the prime has ninety days from its last day of labor or material to give the prime written notice, and one year from that same day to sue on the bond. Missed windows are invisible in a profit and loss and fatal to a receivable, because the deadline is a statute and not a negotiation. Check the notice dates against the last day worked on every federal job in the ageing.
