Definition

The permit coverage a site needs before the first blade, held by the operator.

Why It Matters

One acre of land disturbance is the trigger, and work under an acre counts if it is part of a larger common plan that will disturb one. The operator named on the notice carries the enforcement exposure, which is why a change of ownership is a permit event on every open site at once and not a filing to do afterwards. Ask for the open notices by site and read whose name is on each, because the seller's entity may still be the named operator on a job the buyer is now running.
