# Supplier pricing tier

A term used when buying painting.

The volume tier and rebate a paint supplier gives this account, which no filing or notice period protects.

This lever has less law behind it than any other on the shelf, and saying so is the finding. Federal price-discrimination law reaches paint sold for use or consumption, and a volume rebate is a price term under it, so the tier is not lawless. A claim still needs a competing contractor paying less for like goods, an injury to competition, and no cost or quantity difference the statute itself allows. No dealer-protection statute reaches a purchase account: the broadest needs a dealership with a community of interest, and Wisconsin's courts hold that an ordinary buyer and seller relationship falls outside it. So the tier carries no filing and no notice period when it moves. Get two years of invoices and the rebate statements, and price the tier as something to renegotiate in the first week.
