# Home solicitation contract

A term used when buying landscaping.

A contract signed away from the seller's own premises, which California lets the buyer cancel in three days.

California decides this by PLACE and not by who called first: any contract for services made somewhere other than the seller's own trade premises, for twenty-five dollars or more, is a home solicitation contract. The Business and Professions Code names landscaping in its own list of home improvements. The customer has until midnight of the third business day to cancel, or the fifth if they are sixty-five or older, and a licensed landscaper's home improvement contract runs that clock from the day the buyer receives a signed copy. Two neighbors write it differently, and the difference is worth knowing before pricing a book of signed work. Florida excludes a sale the customer requested outright. Ohio excludes one only where the seller also keeps a fixed place of business in the state, and bars the seller from starting work at all while the window is open.
